By accessing and using OR Planner, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Local Storage Only: OR Planner operates entirely within your browser using local storage. All data including patient information, surgical schedules, case details, and uploaded media files are stored locally on your device and never transmitted to external servers.
No Server Storage: We do not collect, store, or have access to any of your data. Your information remains completely private and under your sole control.
Data Backup: You are responsible for backing up your data using the export functionality. We cannot recover lost data as we do not have access to it.
NOT FOR PATIENT CARE: OR Planner is strictly a scheduling and organizational tool. It is NOT intended for use in actual patient care settings, patient diagnosis, treatment decisions, surgical planning, or any clinical decision-making that affects patient outcomes.
Educational/Training Use Only: This tool is designed for educational purposes, training scenarios, and non-patient administrative scheduling only. It must NOT be used with real patient data or in clinical environments.
Restricted to Board-Certified Ophthalmologists: Use of OR Planner is restricted to board-certified ophthalmologists who understand the limitations and appropriate use of this tool. Residents, medical students, or non-ophthalmology personnel should not use this application.
No Patient Harm Liability: We expressly disclaim any responsibility for patient harm, morbidity, mortality, complications, or adverse outcomes that may result from any use or misuse of this application, whether direct or indirect.
Not a Medical Device: OR Planner is not a medical device, has not been evaluated by the FDA, and does not meet medical device standards for patient care.
As-Is Basis: OR Planner is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Maximum Liability Exclusion: In no event shall the creators, contributors, or distributors of OR Planner be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages (including, but not limited to, patient harm, morbidity, mortality, medical malpractice claims, loss of medical license, procurement of substitute goods or services, loss of use, data, or profits, business interruption, legal fees, or regulatory sanctions) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use or misuse of this software.
Medical Malpractice Exclusion: We expressly disclaim any liability for medical malpractice claims, professional negligence, or failure to meet standard of care that may arise from use of this application.
Data Loss and Security: We are not responsible for any loss, corruption, or unauthorized access of data, including patient information, schedules, or media files. Users assume all risk for data security and backup.
Regulatory Compliance: We are not liable for any regulatory violations, sanctions, or penalties that may result from your use of this application.
HIPAA Responsibility: If you choose to enter any patient health information (PHI) into this application, you are solely responsible for HIPAA compliance. This includes ensuring proper safeguards, access controls, audit logs, and breach notification procedures. We provide no HIPAA compliance features or protections.
PHI Prohibition: We strongly recommend against entering any real patient health information, including names, dates of birth, medical record numbers, or any other identifiable health information into this application.
Business Associate Agreement: No business associate agreement exists between users and the creators of this application. We are not HIPAA-covered entities and do not provide HIPAA-compliant services.
Security Limitations: While data is stored locally in your browser, we make no guarantees about the security of this storage method. Browser-based storage may be vulnerable to various security risks including but not limited to: browser extensions that can access local storage, malware on your device, browser vulnerabilities, shared computer access, and screenshots or exports being shared. Browser extensions installed on your device may have the ability to read, modify, or transmit your locally stored data.
Institutional Approval Required: You must obtain explicit approval from your institution's compliance, IT security, and legal departments before any use in a healthcare environment.
Audit and Documentation: You are responsible for maintaining all necessary documentation and audit trails required by HIPAA and your institutional policies.
Board Certification Requirement: Use of this application is restricted to board-certified ophthalmologists. By using this application, you represent and warrant that you hold current, valid board certification in ophthalmology.
Medical License Verification: Users must maintain current, unrestricted medical licenses in good standing. Any restrictions, suspensions, or disciplinary actions affecting your medical license may disqualify you from using this application.
Professional Standards Compliance: Use must comply with all applicable professional standards including those set by the American Academy of Ophthalmology, state medical boards, and institutional policies.
No Substitute for Clinical Judgment: This application cannot and must not replace clinical judgment, professional expertise, or established medical protocols.
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of OR Planner after any such changes constitutes your acceptance of the new terms.
User Indemnification: You agree to indemnify, defend, and hold harmless the creators, distributors, and contributors of OR Planner from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from your use or misuse of this application, including but not limited to medical malpractice claims, HIPAA violations, or patient harm.
Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law: These terms shall be governed by and construed in accordance with applicable federal and state laws. Any disputes shall be resolved through binding arbitration.
